Armed Forces Tribunal: No pension for Gorkha soldier's 2nd wife even if polygamy allowed in Nepal
The Armed Forces Tribunal (AFT) has clarified that only the first wife of Gorkha soldiers is entitled to family pension after the soldier's death, even though plural marriages are allowed as per their customs. The AFT dismissed a plea by Pin Maya Kumal, the second wife of a deceased Gorkha ex-serviceman, who claimed entitlement to pension. The tribunal held that the deceased soldier's second marriage was void as he did not seek permission as per the Army regulations. The AFT's decision was based on the fact that the deceased soldier had not recorded his second marriage in his service documents.
