Dismissal of an employee in jail, without fair hearing, illegal: HC
The Punjab and Haryana high court has made it clear that dismissal of an employee, who was not in position to defend himself against departmental proceedings on account of confinement in jail in some criminal case, would be illegal. The HC has held that “the opportunity that needs to be granted to a delinquent is not merely a formality but has to be reasonable and adequate”.
